Welcome to PathYatri (hereinafter referred to as "the Platform"). By using this Platform, you agree to be bound by the following Terms and Conditions. Please read these terms carefully before proceeding. If you do not agree to these terms, you must refrain from using the Platform.
2. Role of the Platform
The Platform acts solely as an intermediary to facilitate bookings between passengers and independent third-party service providers (drivers or transport companies). We do not own, operate, manage, or control any transportation services, nor do we employ or supervise drivers. All transportation services are provided directly by independent third parties.
3. Liability and Disclaimer
3.1 No Liability for Third-Party Actions
The Platform shall not be held liable for any acts, omissions, negligence, misconduct, accidents, delays, disputes, or unlawful activities, including but not limited to personal injury, theft, loss, or damage caused by drivers or passengers during the course of transportation services facilitated through the Platform. Any issues arising between passengers and service providers must be resolved directly between the involved parties.
3.2 Disclaimer of Warranties
The Platform makes no representations or warranties regarding the quality, safety, legality, or reliability of transportation services provided by third parties. Use of the Platform is entirely at your own risk, and users are advised to exercise caution and discretion.
3.3 Limitation of Liability
To the fullest extent permitted by applicable law, the Platform disclaims all liability for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the Platform or any transportation services booked through it. In any case, the total liability of the Platform, if any, shall not exceed the amount of service fees, if any, paid to the Platform for its use.
3.4 Indemnity
By using this Platform, you agree to indemnify, defend, and hold harmless the Platform and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms and Conditions, or disputes with third-party service providers.
3.5 Compliance with Law
This Platform operates in compliance with Indian laws, including those applicable in the state. Any disputes arising out of or in connection with the use of the Platform shall be governed by and construed in accordance with the laws of India. The courts of Patna, Bihar, shall have exclusive jurisdiction to resolve such disputes.
3.6 Force Majeure
The Platform shall not be held responsible for any failure or delay in providing its services due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, or other unforeseen events.
